According to the author, a committee of the chiefs under the direction of Mr. Sawers, the Judicial (afterwards the Revenue) Commissioner, prepared a code of Kandyan Law; which was arranged in a systematic manner by the secretary, a priest, of the Malwatta Monastery. The original copy of the manuscript was for a long time in Mr. Armour’s possession, after which it , or a copy of it, passed into the hands of Wegodapola, the High Priest of the Pattini Dewale in 1879. Form him, Welagedara, then Korala of Pallepane, afterwards Ratemahatmaya of Kotmale, obtained a copy; and from this gentleman Panabokke Banda, the Ratemahatamaya of Udapalata, secured another, which his nephew, Mr. Panabokke, the President of Dumbara, transcribed and made a rough translation of. This came into the hands of the author in 1876, since when he had, to the best of his ability, re – translated and re-cast it into its present form.
The subject of the Kandyan institutions is so little known, that a description of the constitution and the principal features of the Kandyan kingdom as it existed in its last days would be a fitting prelude to the study of its particular laws, and the author has accordingly prefixed a short account. In this short account the author describes the constitution of the kingdom, administration of justice, the Great Court or Maha Naduwa, jurisdiction of Adikars, etc.
“In this island of Lanka, there are three kinds of law. Or these Royal law and Sacred law have been from ancient times set froth in books. Not that kind of law which is called “Traditional Law has not as yet been committed to writing.
As the law therefore must have been often doubtful and uncertain, in the interests of the Sinhalese community, that the dispenser of justice may learn what is, and avoid bias in their investigations, and that Sinhalese law may be better known, I undertake this work.
It is called Niti-Nighanduva, and is compiled from the archives of the Court of Kandy with the help of elders versed in the ancient law. Its contents may be summarized as the derivation and the general purport of the term law, and a brief account of what is legal and what is not.
